Terms and Conditions for Giveaways
1. Organiser

(hereinafter referred to as the "Organiser")
2. Scope
These Terms and Conditions apply to all giveaways organised by the Organiser via Instagram and/or Facebook.
By participating in a giveaway, participants accept these Terms and Conditions.
3. Eligibility
Natural persons aged 13 or over are eligible to participate.
Participants under the age of 18 require the consent of a parent or legal guardian.
Participation is generally open worldwide, provided that participation and the delivery of the prize are legally permitted in the respective country.
Employees of the Organiser as well as employees of companies and partners directly involved in carrying out the respective giveaway are excluded from participation.
Participants may also be excluded if they provide false information, use automated systems or bots, use fake accounts or accounts created solely for entering giveaways, or otherwise violate the applicable giveaway rules.
The Organiser reserves the right to exclude participants in the event of suspected manipulation, misuse or any other breach of these Terms and Conditions.
4. How to Enter
The specific requirements for participation will be stated in the respective giveaway post on Instagram and/or Facebook.
Depending on the giveaway, participation may, for example, require the following actions:
- Following the official KHEbikes account
- Liking the giveaway post
- Commenting on the giveaway post
- Tagging other users
- Sharing the post or Story
The requirements that must be fulfilled in each individual case are determined solely by the respective giveaway post.
Multiple entries are only permitted if this is expressly stated in the respective giveaway.
Participation is free of charge and is not conditional on making a purchase, unless expressly stated otherwise in the respective giveaway.
5. Giveaway Period
The start and end dates of the respective giveaway will be stated in the relevant giveaway post.
Entries submitted outside the specified participation period may not be considered when selecting the winner.
6. Winner Selection and Notification
After the giveaway has ended, the winner or winners will be selected at random from all valid entries, unless another method of winner selection is stated in the respective giveaway.
The winner may be notified, for example, by direct message, by a comment under the giveaway post or via an Instagram or Facebook Story published by the Organiser.
The winner must contact the Organiser within 72 hours of notification and provide the information required to process and deliver the prize.
If no response is received within this period, the Organiser reserves the right to select a new winner.
7. Prizes
The respective prize will be described in the relevant giveaway post.
Cash payment, exchange or transfer of the prize to another person is excluded.
The Organiser reserves the right to replace the prize with an equivalent prize if the originally announced prize is unavailable for unforeseen reasons.
8. Shipping and Customs Charges
Prizes will be shipped worldwide where legally permitted.
Any import duties, customs charges, taxes or other fees incurred in the recipient's country must be paid by the winner.
To the extent permitted by law, the Organiser accepts no responsibility for delivery delays, customs clearance issues, or shipments lost or damaged by the shipping provider.
The winner is responsible for providing a complete and correct delivery address.
9. Liability
The Organiser accepts no liability for technical problems, outages of Instagram or Facebook, loss of data, transmission errors, or incomplete or late entries.
To the extent permitted by law, the Organiser shall only be liable for damage caused intentionally or through gross negligence.
Mandatory statutory liability provisions remain unaffected.
10. Changes or Early Termination of the Giveaway
The Organiser reserves the right to modify, suspend or terminate a giveaway at any time without prior notice if legal, technical or organisational reasons make this necessary.
This applies in particular if the proper conduct of the giveaway can no longer be guaranteed for technical or legal reasons.
11. Data Protection
Personal data collected in connection with the giveaway will be processed solely for the purpose of conducting and administering the giveaway.
This may include the following data in particular:
- Instagram or Facebook username
- First and last name
- Postal address
- Email address
The data collected will not be passed on to third parties unless this is necessary for conducting the giveaway or delivering the prize.
Personal data will be deleted once the giveaway has been fully completed, unless statutory retention obligations require otherwise.

12. Release of Instagram and Facebook
This giveaway is in no way connected with Instagram or Facebook and is not sponsored, supported or administered by Instagram or Facebook.
Instagram and Facebook are not responsible for answering questions regarding the respective giveaway.
All questions, comments or complaints relating to the giveaway must be directed exclusively to the Organiser.
To the extent permitted by law, participants release Instagram and Facebook from any claims arising in connection with the conduct of the giveaway.
13. Applicable Law
The law of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Should any individual provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
